Terms of Service

1. Agreement
These Terms of Service (“Terms”) govern your access to and use of the TYMZH websites, mobile applications, games, consulting engagements, and related services (collectively, the “Services”). By using any of our Services you agree to be bound by these Terms and all applicable policies referenced here.
2. Professional services
Each professional project is governed by a Statement of Work or Master Services Agreement outlining scope, deliverables, responsibilities, and payment schedules. In the event of conflict, the contract supersedes these Terms. You agree to provide timely feedback and access necessary to deliver the engagement.
3. Use of apps and games
Where we provide mobile applications or games, you are granted a limited, non-exclusive, non-transferable license to install and use them for personal and non-commercial purposes, subject to these Terms and any platform rules (such as Google Play or the App Store). You agree not to reverse engineer, resell, or misuse the apps or games, and to comply with any age ratings and content restrictions applicable in your region.
4. Accounts and security
You are responsible for safeguarding any credentials issued by TYMZH and for all activity occurring under your account. Notify us immediately of any unauthorized access or suspected breach. We reserve the right to suspend access when security is at risk.
5. Intellectual property
Unless otherwise stated in an executed contract, TYMZH retains ownership of its pre-existing materials, frameworks, games, artwork, and know-how. Upon full payment, applicable deliverables are assigned or licensed according to the governing agreement. You grant TYMZH a limited license to use your feedback and branding for showcasing the work unless you opt out in writing.
6. Confidentiality
Both parties agree to protect confidential information using a standard of care no less stringent than that used to protect their own confidential data. Confidential information may be disclosed when required by law, provided that the receiving party gives prompt notice to allow protective measures.
7. Payments
Invoices are due within the timeframe specified in the applicable Statement of Work. Late payments may incur finance charges or suspension of services. All fees are exclusive of taxes, which remain your responsibility unless otherwise stated.
8. Warranties and disclaimers
TYMZH warrants that services will be delivered with professional diligence consistent with industry standards. Except as expressly stated, Services (including any apps or games) are provided “as is” without additional warranties. We disclaim all implied warranties including merchantability and fitness for a particular purpose.
9. Limitation of liability
To the fullest extent permitted by law, neither party shall be liable for any indirect, special, or consequential damages arising from these Terms. TYMZH’s aggregate liability is limited to the fees paid for the services giving rise to the claim.
10. Termination
Either party may terminate services for material breach that remains uncured for thirty (30) days after written notice. Upon termination, you agree to pay for work performed up to the termination date and return any confidential information.
11. Governing law
These Terms are governed by the laws of the jurisdiction where TYMZH is incorporated, without regard to conflict of law principles. Any disputes will be resolved in the courts of that jurisdiction.
12. Changes
We may update these Terms periodically. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
